General Compliance Guidelines

Q

I am aware another employee does not work 8 hours a day, but this information is not recorded on the roster. Should I do something?

A

Yes. Discuss this issue with your supervisor. Be aware that depending on the employee classification (exempt, A&P, faculty) some employees are not paid according to the specific number of hours they work.

Q

I am an Administrative and Professional employee at UTMB. When I leave work early for the day, do I have to record Vacation or Sick Leave?

A

No. Administrative and Professional (A&P) employees are paid a salary to do a job no matter how much time it takes. A&P employees must record vacation and/or sick leave when applicable. Extra days in advance or following a paid leave trip must be recorded as vacation leave.

Can employees who request sick leave for a doctor’s appointment be required to return to work with a doctor’s note?

A

Yes. If you requested sick leave for a doctor’s appointment for yourself or your immediate family (spouse or dependent child), your supervisor may request a doctor’s note.

Q

Who decides whether my absences from work qualify for Family Medical Leave?

A

It is UTMB’s responsibility to determine whether your illness meets the eligibility requirements of the Family Medical Leave Act. The employee’s failure to complete the required FMLA documentation forms may mean that his/her position at UTMB is not protected. Check with the UTMB Human Resources Dept. if you have questions about Family Medical Leave.

Q

I am a nonexempt classified employee. I like to get all of my work done, so I come in early and stay late on most days, but I only record 8 hours time either in the Electronic Time Capture system or on my time sheet each day. Is this okay?

A

No. Employees who are classified nonexempt must be paid for the entire amount of time they spend on the job. If you work more than 40 hours in a week, you must receive approval from your supervisor before you work the hours and receive overtime pay. If you don’t know whether you are a nonexempt classified employee, ask your supervisor.

Fair Labor Standards Act. The federal Fair Labor Standards Act (FLSA) requires that UTMB maintain accurate time and leave records for all non-exempt employees. Under the provisions of the FLSA, non-exempt employees will be paid for overtime worked at a rate of one and a half times their hourly rate for “productive hours worked.”

Classified non-exempt employees are paid overtime for any hours worked (does not include leave time) beyond 40 hours in a specific workweek. All UTMB non-exempt academic employees are 40-hour cycle employees. Hospital non-exempt clinical employees are 8/80-hour cycle employees. Overtime payment calculations are different for each cycle.

Classified exempt employees may be compensated with compensatory time off at a mutually convenient time for both the employer and the employee within one year from the date it is earned. Classified exempt employees may be paid overtime or straight-time if the arrangement is approved in advance of working the time. This type of arrangement must be approved by the appropriate UTMB Vice President or Dean.

Administrative and Professional (A&P) employees are not eligible for overtime or compensatory time. A&P employees who are required to work on an official UTMB holiday may receive a day off on an other date within the fiscal year.

Your supervisor must specifically approve overtime and compensatory time, before it is worked. For detailed information regarding overtime contact your Human Resources Department. Exempt and non-exempt time keeping. All employees eligible to earn vacation and sick leave must report vacation and sick leave taken in accordance with UTMB procedures. Employees must maintain complete worked time and specific leave records to account for hours worked, vacation, sick leave, compensatory, equivalent, and floating holiday balances. Family and Medical Leave Act. If you satisfy the eligibility criteria, you may request and receive a leave of absence without pay for up to twelve (12) weeks per year for certain family and medical reasons.
