Definition

Procurement of Professional Services in accordance with Texas Education Code, Section 74.008, and UT System Rules & Regulations, generally includes services in the following areas:

  • Accounting
  • Architecture (Can only be acquired by FOAM)
  • Land Surveying (Can only be acquired by FOAM)
  • Medicine
  • Optometry
  • Professional Engineering
  • Real Estate appraising (Can only be acquired by FOAM)

Provided that in connection with the performance of the services, the person providing the services is licensed as:

  • Certified Public Accountant (CPA)
  • Architect
  • Land Surveyor
  • Physician, Nurse or Medical Practitioner
  • Optometrist
  • Professional Engineer
  • State Certified or State Licensed Real Estate Appraiser

 

What do I need to do?

Due to the rules and regulations involved in acquiring Professional Services, listed below, first contact Logistics/Acquisition at 7-8001 to assist you.  Second, complete the Professional Services Request Form and forward it to Logistics/Acquisition.

If this request can only be acquired from one particular firm, please go ahead and complete a Sole-Source Justification and forward to Logistics/Acquisition.

Also, If this request is awarded to a sole-proprietor or individual the Employee/Independent Contractor Verification Checklist will need to be completed. Logistics/Acquisition can assist you in completing this form.

Acquisition Procedure

1.0  Acquisition of Professional Services

Solicitation, evaluation and selection of firms providing Professional Services shall be consistent with the following guidelines and UTMB’s Historically Underutilized Business (HUB) Procedure.

UTMB Department/Process Area shall provide Logistics/Acquisition with the following documentation:
Professional Services Request Form
Solicitation of competitive proposals/quotations 
from qualified firms and responses thereto, or a 
Sole-Source Justification
, if applicable

Selection Criteria used to evaluate proposals/quotations (e.g., demonstrate
competence and qualifications; Professional 
Fees consistent with industry practices
); 
Selection Criteria can not include, or be based 
on, total project Cost/Price

Recommendation of Selection based on the 
Selection Criteria

2.0  Contracting with the Selected Firm

Once a firm is selected, Legal Affairs will then prepare a Contract for the Professional Services. The Contract must be signed by the Selected Firm and UTMB. After which, a Purchase Order can be issued for payment purposes referencing the Agreement/Contract as the controlling document.

If the amount of the Contract is over $25,000, including expenses, then the Contract may be sent to UT System’s Office of General Counsel (OGC) for review and approval.
