What should be done?

  1. (Incorrect) The patient should be transferred immediately to the ED that has a contract with your patient.  

    Though the managed care company may require prior notification in order to authorize services, EMTALA does not recognize this contractual agreement. Most managed care companies request authorization within 24 hours, and authorize reasonable and prudent care.

    After the patient is truly stabilized transfer arrangement can be done by following the proper procedures. 

  2. (Correct) Medical care should continue uninterrupted.

  3. After the patient is truly  stabilized transfer arrangement can be done by following the proper procedures.
